Privacy policy

This Privacy Policy describes how PhemosReach collects, uses, and shares your personal information when you use our service. This site itself sets no cookies and stores no analytics identifier before you sign up.

1. Who we are

PhemosReach ("PhemosReach", "we", "us", or "our") is a content planning and publishing service operated by Modus Future. This policy explains what personal information we collect when you use PhemosReach, how we use it, who we share it with, and the choices and rights you have. 2. Information we collect

We collect the following categories of information:

  • Account information. When you sign up, our authentication provider (Clerk) processes your name, email address, and sign-in credentials on our behalf. We store your user and workspace records.
  • Connected social accounts. When you connect a platform such as Discord, LinkedIn, Reddit, X (Twitter), Mastodon, Tumblr, Pinterest, Meta (Facebook and Instagram), Google (YouTube), TikTok, or Snapchat, we receive and store access tokens and basic profile details (such as your account ID and display name) needed to publish and read content you authorize. Access tokens are encrypted at rest.
  • Content you create. Briefs, drafts, schedules, media, and other content you produce or upload are stored so the service can function.
  • Billing information. Payments are processed by Stripe. We do not store full card numbers; we retain limited billing metadata such as your subscription status and plan.
  • Usage and technical data. We log technical information such as IP address, device and browser type, and actions taken in the app, to operate, secure, and improve the service.
  • Newsletter subscribers. If you use our newsletter feature, we store the email addresses and any names of the people who subscribe to your newsletter. Those people are not PhemosReach users, and we process their details only to deliver the newsletters you send and to honour unsubscribe requests. You are responsible for having a lawful basis to contact them.
  • Public content about you or your brands. If you use comment monitoring or brand and mention listening, we retrieve and store public posts and comments from the platforms you connect. These records can include another person's username, display name, and the text they wrote. We store them so you can read and reply to them, and we delete them with the connected account or monitor they belong to.

3. How we use your information

We use the information we collect to:

  • Provide, maintain, and operate PhemosReach.
  • Generate and draft content using AI, and publish or schedule content to the platforms you connect, at your direction.
  • Process payments and manage your subscription.
  • Provide support and respond to your requests.
  • Secure the service, prevent abuse, and comply with legal obligations.

We do not sell your personal information, and we do not use the content of your connected accounts for advertising.

4. AI processing

PhemosReach uses third-party AI providers to help generate and refine content. We currently use Google (Gemini) for text and image generation, and OpenAI and Anthropic as alternative text providers. When you use an AI feature, the relevant prompt and content, which may include the material you asked us to work on, are sent to whichever provider handles that request.

If you supply your own AI provider key (available on higher plans), requests made with that key go directly to that provider under your own account and your agreement with them, and their terms rather than ours govern how they handle that data. We store your key encrypted at rest and use it only to make requests on your behalf.

We do not use your content to train our own models, and we rely on our AI providers to handle that data under their terms rather than to train their general models on it where those terms allow. AI output can be inaccurate, so you should review anything before publishing it.

5. How we share information

We share information only as needed to run the service, and with service providers (subprocessors) who act on our behalf under contract, including:

  • Clerk for authentication and identity.
  • Neon for database hosting.
  • Cloudflare R2 for media and file storage.
  • Google (Gemini), OpenAI, andAnthropic for AI content generation.
  • Brevo for sending email, including team invitations, notifications, and any newsletters you send to your subscribers.
  • Stripe for payment processing.
  • Fly.io for application hosting.
  • Axiom for application logs, which can include email addresses, retained for about 30 days.
  • Sentry for error monitoring and diagnostics.
  • PostHog for product analytics, and only where you have agreed to it.
  • The social and content platforms you connect, when you ask us to read from or publish to them on your behalf.

We may also disclose information if required by law, or to protect the rights, safety, and security of PhemosReach, our users, or the public.

6. Platform data and limited use

Our use of information received from platform APIs adheres to each platform's developer terms and policies, including the Google API Services User Data Policy (including its Limited Use requirements), the Meta Platform Terms and Developer Policies, and the terms of X, TikTok, LinkedIn, Reddit, Snapchat, Pinterest, and the other services we support.

Data obtained from these platforms is used only to provide and improve the features you have connected them to. We do not transfer or sell that data, and we do not use it for advertising or for any purpose unrelated to the features you use.

7. Data retention and deletion

We keep your information for as long as your account is active or as needed to provide the service. You are in control of your data:

  • You can disconnect any connected platform at any time from Settings, which revokes and deletes the stored access token for that account.
  • You can delete individual content items you have created.
  • You can export a copy of your personal data, or request erasure, from Settings under Privacy and Compliance.
  • Anyone who receives a newsletter you send can unsubscribe using the one-click link in every message, which takes effect immediately and needs no account. You can also remove a subscriber from your subscriber list.
  • You can request deletion of your account and associated personal data by contacting [email protected]. We will delete or anonymize your personal data within a reasonable period, except where we are required to retain it to meet legal obligations.

8. Your rights

Depending on where you live, you may have rights to access, correct, delete, or export your personal data, to object to or restrict certain processing, and to withdraw consent. These include rights under the EU and UK GDPR and the California Consumer Privacy Act (CCPA).

To exercise any of these rights, contact us at[email protected]. We will respond in line with applicable law. You also have the right to complain to your local data protection authority.

9. Security

We protect your information with technical and organizational measures, including encryption in transit (TLS) and encryption at rest for sensitive values such as social account access tokens. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your data and to respond promptly to any incident.

10. International transfers

PhemosReach is operated from Australia, and our application and database are hosted in the Sydney region. Our service providers listed above may process your information in other countries, including the United States and the European Union. Where we transfer personal data internationally, we rely on appropriate safeguards, such as standard contractual clauses, to protect it.

11. Children

PhemosReach is not intended for children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.

12. Changes to this policy

We may update this policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of PhemosReach after an update means you accept the revised policy.
